Elevator Technicians and Helpers are Required to be Licensed to Perform Elevator Work
Since January 1, 2022, the New York State Elevator Safety Act requires both a New York City and New York State License to perform elevator work. Two Elevator Agency Technician Licenses and an Elevator Agency Helper Registration Card are available to qualified applicants.

Follow-up #6 - Local Law 152 of 2016: Requests for Due Date Extensions to Complete Gas Piping Inspections
An amendment to Local Law 152 of 2016 allows building owners to receive a 180-day extension of the due date for the inspection of the building’s gas piping system and submission of the GPS2: Gas Piping System Periodic Inspection Certification form to the Department of Buildings. See Local Law 138 of 2021.

Temporary Amusement Device Inspection Requests to be Submitted to the Department of Buildings in DOB NOW: Safety
Beginning March 18, 2022, requests for inspections of temporary amusement devices must be submitted to the NYC Department of Buildings in DOB NOW: Safety. These requests are no longer submitted to the NYC Department of Consumer and Worker Protection.

Properties with Board of Standards of Appeals Decisions will be Flagged in the Property Profile
Beginning March 8, 2022, buildings that have been the subject of a decision by the Board of Standards of Appeals (BSA) after 1998, will be flagged in the Buildings Information System (BIS) Property Profile and DOB NOW.

Follow-up #3: Local Law 152 of 2016: Gas Piping Inspections Deadline for Community Districts 1, 3 and 10 in all Boroughs Extended
Exposed gas piping systems in all buildings, except one- or two-family homes, must be inspected by a Licensed Master Plumber (LMP), or a qualified individual working under the direct and continuing supervision of a LMP, at least once every four years according to the schedule set out in 1 RCNY §103-10. A new bill approved by the City Council on December 17, 2020, and expected to become law on January 18, 2021,extends the inspection deadline for buildings in Community Districts (CD) 1, 3, and 10 in all boroughs from December 31, 2020, to June 30, 2021.

Local Law 191 of 2018: Deadline for Installation of Carbon Monoxide Detectors in Commercial Spaces Extended
Local Law 191 of 2018 requires buildings that are equipped with a fire alarm system and contain Occupancy Group A-1, A-2, A-3, Group B or Group M to install carbon monoxide detectors by January 1, 2021. A new bill approved by the City Council on December 17, 2020, and expected to become law on January 18, 2021, extends the deadline for compliance to July 1, 2021.

General Construction (Phase One) and Other Work Types to Launch in DOB NOW: Build
A major expansion and upgrade of DOB NOW: Build will be occurring in multiple phases. Phase 1 is launching on December 28, 2020.

New Tenant Protection Plan Requirements and Updated TPP1 and PW2 Forms
Beginning November 10, 2020, as required by Local Law 106 of 2019: The registered design professional (RDP) who prepares the tenant protection plan (TPP) must be retained by the general contractor; and the permit holder must sign a statement certifying that the TPP submitted by the RDP coordinates with the scope of work intended.

Local Law 15 of 2020: Bird Friendly Building Design
Effective January 10, 2021, new buildings and alterations that replace all exterior glazing of a building must comply with bird friendly design construction requirements.

Training for DOB NOW: Build Upcoming Expansion
In preparation for a major expansion and upgrade of DOB NOW: Build that will occur later this year, DOB will be conducting online training.

New Requirement: Temporary Certificate of Occupancy (TCO) Worksheet
Beginning Monday, November 9, 2020, applicants requesting an initial Temporary Certificate of Occupancy (TCO) or TCO Renewal with Changes must use the new 3-page PW7: Review Request form, which includes a TCO Worksheet on pages 2 and 3. The TCO Worksheet must be completed for review by the Borough Commissioner’s Office.

Manual Appointment Requests: Updated PER11 Appointment Request Form
Beginning November 2, 2020, applicants seeking to schedule a manual or specialized appointment with a Plan Examiner or Borough Commissioner’s office must complete the new PER11 Appointment Request form (Rev. 10/20) and email it to the appropriate email address indicated on the form.

Follow-up #2: Local Law 152 of 2016: Periodic Inspection of Gas Piping Systems Required
By December 31, 2020, owners of buildings, except one- or two-family homes, located in Community Districts 1, 3 and 10 in all boroughs must submit to the Department of Buildings a signed and sealed GPS2: Gas Piping System Periodic Inspection Certification through the online portal at www.nyc.gov/DOBgaspipecert.

Increase in DOB Civil Penalties for Failing to File an Acceptable Certificate of Correction for an Immediately Hazardous Class 1 Summons (AEUHAZ)
Effective October 3, 2020, Section 102-05 of the Rules of the City of New York has been amended to change the penalty structure for buildings other than one- and two-family dwellings that fail to file an acceptable certificate of correction for an Immediately Hazardous Class 1 summons.

Immediately Hazardous and Benchmarking Violation Civil Penalty Payments Required to be Paid Online
Effective November 2, 2020, Immediately Hazardous (AEUHAZ) and Benchmarking Violation Civil Penalty payments cannot be mailed in or paid in-person and must be submitted in eFiling.

COVID-19 Response: Rigging, Scaffold and Concrete Safety Refresher Training Card and Certificates Require Renewal by November 9, 2020
All refresher training program requirements for site safety training cards or certificates required by Sections 3314.4.5 or 3316.9.2 of the New York City Building Code and Section 104-06 of Title 1 of the Rules of the City of New York that were suspended by Mayoral Emergency Executive Order No. 120, are now suspended through November 9, 2020, per Mayoral Emergency Executive Order No. 149.

Appointments for Disapproved BIS Jobs and PAAs
Beginning October 15, 2020, disapproved BIS jobs, resubmissions and Post Approval Amendments (PAAs) reviewed by Department of Buildings plan examiners may not require an appointment.

Façade Amnesty Program Extended to October 31, 2020
The current amnesty period for the Façade Inspection and Safety Program (FISP) is now extended to October 31, 2020. The amnesty program is only open to non-compliant Cycle 8 owners and will not be extended further.

Building Owners Required to Post Building Energy Efficiency Rating Label – Local Law 33 of 2018 as amended by Local Law 95 of 2019
No later than October 31, 2020, and October 31 of each year after 2020, owners of buildings over 25,000 square feet – or multiple buildings on a lot that total 100,000 square feet or more – that appear on the NYC Benchmarking Covered Building List must post a Building Energy Efficiency Rating Label in a conspicuous location near each public entrance to their buildings.

Local Law 196 of 2017: Safety Training Deadline Extended
Local Law 196 of 2017 mandates that construction and demolition workers at job sites required to designate a Site Safety Professional must receive 40 hours of safety training. The NYC Council passed a bill to extend the full compliance date to complete the required training from September 1, 2020 to March 1, 2021.

License Renewal Applications Must be Submitted Online and are Subject to New Expiration Dates as a Result of the Mayor’s Emergency Executive Order
Department of Buildings license/registration renewal applications are required to be submitted online at www.nyc.gov/dobnow within 30 to 60 days from their expiration dates. Renewal applications will not be accepted in-person or by mail.

Customer Service Windows Closing at 12:00 pm on Tuesday, August 4, 2020
In preparation for Tropical Storm Isaias, all DOB Customer Service Windows will close at 12:00 pm on Tuesday, August 4, 2020. Drop-off services will also be closed.

Local Law 114 of 2019: Denial of Permits for False Statements and Work Without a Permit
Beginning August 5, 2020, DOB will deny initial work permits for multiple dwellings where the Department has issued a summons for submitting a false statement on a Plan/Work Application (PW1) regarding the occupancy status of the building (Section 26 of the PW1), or performing Work Without a Permit while the building was occupied. The one-year permit restriction will apply if the summons was issued on or after December 5, 2019 – the effective date of Local Law 114 of 2019. The restriction will remain in effect for one-year from the issuance of the summons. However, the permit restriction can be removed before the one-year timeframe if the summons is dismissed by OATH.

HUB Full-Service and Self-Service Update
Beginning Thursday, July 30, 2020, HUB Full-Service and HUB Self-Service jobs in eFiling will be Administratively Closed if the Applicant of Record has not paid for the initial filing within 90 days of it being assigned a job number.

Property Owners and Other Responsible Parties are Required to Report Construction Site Incidents
To comply with Local Law 78 of 2017, property owners, contractors, subcontractors, or person(s) otherwise in control of a construction site must report details of an incident to the Department of Buildings within three (3) business days using the Injury/Fatality Incident Information Form. Failure to comply with this mandate may result in a $2,500 civil penalty in accordance with § 28-202.1 and §28-103.21.1 of the Administrative Code.

COVID-19 Response: Benchmarking Guidance for August 1, 2020 Deadline
Due to the ongoing COVID-19 public health emergency, property owners who were not able to submit their CY2019 benchmarking information by May 1, 2020 are required to submit a fully compliant report by August 1, 2020.

COVID-19 Response Update: Litigation Papers, Subpoenas and FOIL Requests
As the City reopens, the Department of Buildings (DOB) continues to make safety a priority. In response to the Coronavirus, DOB has limited the amount of walk-in traffic to DOB offices by developing online processes for in-person transactions. Litigation papers, subpoenas and FOIL requests cannot be hand-delivered and must be submitted online until further notice.

COVID-19 Response: License and Permit Expiration Dates
Licenses and permits are no longer subject to automatic extensions.

Boiler Violation Search Portal, Payments and Waiver Requests to Launch in DOB NOW: Safety on July 22, 2020
On Wednesday, July 22, 2020, a new Boiler Violations Portal will launch in DOB NOW: Safety. The portal will allow the public to search for boiler violations at a property and any amount due for these violations. It will be mandatory to submit in DOB NOW: Safety all payments for Failure to File an annual inspection report for low- and high-pressure boilers and requests to waive civil penalties resulting from these violations.

Fee Amendments to Facade Report Filings
Façade inspection report fees will increase beginning July 15, 2020. Amendments.

COVID-19 Stop Work Orders Rescission Portal
Beginning July 8, 2020, construction sites that do not follow COVID-19 safety guidance by failing to have a Safety Plan and/or affirmation posted conspicuously and available for inspection or failing to have at least one hand washing or hand sanitizing facility will be issued a Stop Work Order (SWO). A portal will be available in DOB NOW: Safety to submit SWO Rescind Requests.

REMINDER: Inspect Elevator Controller Mechanical and Electrical Components Specific to the Braking System
Licensed Elevator Agencies are reminded that they are required to inspect the main braking systems, and emergency braking systems, including all electrical and mechanical components used in brake operation, on all automatic passenger and freight elevators during scheduled maintenance in accordance with Appendix K1, Section 8.6.4.6.1, of the 2014 New York City Building Code.

Effective June 29, 2020, Licensees and Registered Contractors can submit a single After Hours Variance (AHV) request in DOB NOW: Build for multiple permits including both DOB NOW and BIS permits.

Benchmarking Compliance Reporting Template Relocates from the Mayor’s Office of Sustainability Site to DOB’s Site
The Benchmarking Compliance Reporting Template is now available on the Department’s website under Benchmarking on the Compliance Instructions page. The reporting template must be used to complete the mandatory benchmarking process for Local Laws: 84 of 2009, 133 of 2016, 33 of 2018 and 95 of 2019.

Cranes Filings (Phase Two) to Launch in DOB NOW: Build
Beginning Tuesday, July 7, 2020, all new Crane Notice (CN), Tower Crane Foundation and On-Site Waiver filings must be submitted in DOB NOW, as well as all associated After-Hour Variance (AHV) requests and notifications for arrival, departure, assembly and disassembly. Paper forms will no longer be accepted for new CNs, and fees will no longer be waived for CD amendments.

Elevator Violation Search Portal, Payments and Waiver Requests to Launch in DOB NOW: Safety on June 17, 2020
On Wednesday, June 17, 2020, a new Elevator Violations portal will be launched in DOB NOW: Safety. It will allow the public to search for elevator violations at a property and any amount due for these violations. Payments for ‘Failure to File’ or ‘Failure to File an Affirmation of Correction’ for Category 1 and Category 5 elevator violations and all requests to waive civil penalties resulting from these violations must be made in DOB NOW: Safety.

COVID-19 Response: Local Law 87/09 Energy Efficiency Report Submission Extension
In response to the ongoing COVID-19 public health emergency, owners of covered buildings who are not able to submit the required Energy Efficiency Report (EER) by the December 31, 2020 deadline, due to COVID-19 complications, may file for a six-month extension.

COVID-19 Response: Expansion of Online Training DOB-Approved Course Providers Can Deliver
Effective immediately, DOB-approved Course Providers can deliver training courses in an online setting, exclusive of courses that include hands-on training. All online training must be delivered live through either a Virtual Classroom or Webinar format and must adhere to DOB’s Actively Proctored Online Training Policy and each course provider’s accreditation standards, as applicable.

Mandatory Submission of all Alt-2 and Alt-3 BIS Job Applications in eFiling, Requests Allowed in DOB NOW: Inspections, and Intake of Initial Permit Applications for Non-Essential Construction
Beginning Monday, June 1, 2020, all Alteration Type 2 and Alteration Type 3 BIS job applications must be submitted in eFiling. In addition, requests for inspections will be allowed in DOB NOW: Inspections. DOB NOW: Build will also allow for submission of initial permits. Beginning, Wednesday, June 3, 2020, eSubmit will allow for submission of initial permits for BIS job applications.

Mandatory Submission of all BIS Job Applications in eFiling to launch June 8, 2020
Beginning Monday, June 8, 2020, all BIS job applications must be submitted in eFiling, except the project/work types or additional considerations listed below. In addition, it will be required to electronically submit initial permits and withdrawal applications in eFiling. Online web-based training sessions will be held beginning May 29, 2020 to guide users through the new procedures.

Tenant Protection Plan: Revised TPP1 Form
Beginning June 22, 2020, both the applicant and the property owner will be required to sign the paper TPP1 form submitted in the Buildings Information System (BIS).

Follow-up #1: Tenant Protection Plan Notice to Occupants
Beginning June 22, 2020, owners must distribute and post the required Tenant Protection Plan (TPP) Notice to Occupants when the Department of Buildings issues a work permit. The updated notice reflects the changes made by Local Law 106 of 2019.

Upcoming Façade Amnesty Program to Begin July 1
The Department’s Façade Inspection and Safety Program (FISP) is offering an amnesty period to begin July 1, 2020. The program will run for three months and may be extended at the Department’s discretion. The amnesty program is only open to non-compliant Cycle 8 owners.

COVID-19 Response: Postponement of Rule Hearings (Updated)
As part of the citywide response to the Coronavirus, the Department previously postponed public hearings to limit public interactions. The proposed rule hearings have been rescheduled and will now be conducted remotely via WebEx. View the proposed rules and WebEx meeting information.

2020 NYC Energy Conservation Code in Effect
The 2020 New York City Energy Conservation Code (NYCECC) is in effect May 12, 2020, affecting all new buildings and alterations. All jobs filed on or after May 12, 2020 must comply with the 2020 NYCECC. For prior projects and Incomplete Filings, see Service Notice from February 2020.

COVID-19 Response: Certificate of Authorization, License and Permit Renewal Extension
All licenses/registrations and permits issued by the Department of Buildings and expiring from the beginning of the declaration of the state of emergency through the period of the emergency declaration are extended in accordance with Mayoral Emergency Executive Order. Currently, this period has been extended to June 7, 2020. Approved sites need to post a new Certificate of Authorization with the expiration date of June 7, 2020.

Applications to renew a license/registration issued by the Department of Buildings are required to be submitted online at www.nyc.gov/dobnow. Renewal applications will not be accepted in-person or by mail as of Friday, May 8, 2020.

As of Wednesday, May 6, 2020, applications for Place of Assembly and Place of Assembly Certificates of Operation can be submitted and will be reviewed in DOB NOW: Build. Temporary Place of Assembly applications remain suspended for the duration of the state of emergency.

COVID-19 Response: Online License Renewal Applications
Beginning Monday, May 4, 2020, applications to renew a license/registration issued by the Department of Buildings can be submitted online at www.nyc.gov/dobnow. Renewal applications will not be accepted in-person or by mail as of Friday, May 8, 2020.

COVID-19 Response: Certificate of Occupancy, Letter of Completion, and Temporary Certificate of Occupancy Folder Review Requests (PW7) Required to be Submitted in eFiling; Hub Self-Service Reopened for Submission of PW1 Plan/Work Applications
Beginning Monday, April 27, 2020, Certificate of Occupancy, Letter of Completion and Temporary Certificate of Occupancy Folder Review Requests (PW7) cannot be submitted in-person to a borough office and are required to be submitted in eFiling. Hub Self-Service will now accept submissions of PW1 Plan/Work Applications. In addition, eFiling has been updated for Development Hub Jobs to categorize PW1 Plan/Work Application submissions as initial or subsequent filings.

Crane Filings Launch in DOB NOW: Build, Updated Essential Construction Questionnaire for Electrical and Limited Alteration Applications and Certificates of Correction Mail Submission Deadline
Crane filings (phase one) will launch in DOB NOW: Build on Monday, April 27, 2020. The Essential Construction Questionnaire in the permit application for Electrical and Limited Alteration Applications has been updated to include the revised guidelines in the DOB Guidance Document. The deadline to submit Certificate of Correction requests by mail is May 1, 2020.

COVID-19 Response: Permit Renewal Extension
All permits issued by the Department of Buildings and expiring from the beginning of the declaration of the state of emergency through the period of the emergency declaration are extended in accordance with Mayoral Emergency Executive Order No. 107. Currently, this period runs March 12, 2020 through at least May 9, 2020.

COVID-19 Response: Benchmarking Guidance for May 1, 2020 Deadline and Issuance and Payment of Department of Buildings Violations for Non-Compliance
Due to the ongoing COVID-19 public health emergency, building owners who are not able to submit their CY2019 benchmarking information by May 1, 2020 will not be issued a violation for non-compliance if they submit a fully compliant report by August 1, 2020. In addition, payments for benchmarking violations are required to be submitted in eFiling.

COVID-19 Response: Enhancements to Post Approval Amendment and Correction Submissions in eFiling and Essential Construction Requests Update for Electrical and Limited Alteration Applications Permits and Demolition Filings
The process for submitting Post Approval Amendment applications and correction requests in eFiling has been enhanced. In addition, the Essential Construction requests portal at www.nyc.gov/dobnow has been updated to allow for submission of Electrical and Limited Alteration Application (LAA) permits that were submitted prior to April 3, 2020 and Demolition filings. Certificates of Authorization have been extended for the duration of the state of emergency.

All licenses/registrations issued by the Department of Buildings and expiring from the beginning of the declaration of the state of emergency through the period of the emergency declaration are extended in accordance with Mayor’s Emergency Executive Order No. 107. In addition, the Essential Active Construction Sites map has been updated and approved sites need to post a new Certificate of Authorization with the expiration date of May 15, 2020.

As part of the citywide response to the Coronavirus, Department of Buildings (DOB) customers are being urged to immediately limit the amount of walk-in traffic to DOB offices. Effective Thursday, April 16, 2020, Post Approval Amendments for BIS jobs and Immediately Hazardous Violation Civil Penalty payments must be submitted in eFiling.

COVID-19 Response: Suspension of all work on non-essential construction and demolition sites - Updated
As part of the ongoing COVID-19 public health emergency, in accordance with New York State Executive Order 202.6, Empire State Development guidance and New York City Emergency Executive Order 103, all work on non-essential construction and demolition sites is suspended for the duration of this state of emergency.

COVID-19 Response: Certificates of Correction and Temporary Certificate of Occupancy Renewal Payments
As part of the citywide response to the Coronavirus, Department of Buildings (DOB) customers are being urged to immediately limit the amount of walk-in traffic to DOB offices. Effective Tuesday, April 7, 2020, Certificate of Correction documents and Temporary Certificate of Occupancy (TCO) payments must be submitted online.

COVID-19 Response: Weekly Safety Inspection Reports and New Customer Service Office Hours
As part of the citywide response to the Coronavirus, Department of Buildings (DOB) customers are being urged to immediately limit the amount of walk-in traffic to DOB offices. Effective Saturday, April 4, 2020, Weekly Safety Inspection Reports must be submitted online, and all DOB customer service locations will close at 2:00 pm for drop-offs and in-person transactions.

Façade Inspection and Safety Program: Cycle 9 Amnesty Program for Non-Compliant Owners – Cycle 8 Owners Only
For a limited time only and in the interest of public safety, the Department of Buildings is offering an Amnesty Program to owners who failed to file (No Report Filed or NRF) a Façade Report during Cycle 8. The Façade Inspection and Safety Program (FISP) Cycle 8 reporting period ended February 20, 2020, and this amnesty period will allow owners to administratively close Cycle 8 with the Cycle 9 Report.

COVID-19 Response: Appointments for Standard Plan Review BIS Job Filings

Periodic Parking Garage Inspections
New York State recently enacted requirements for the periodic inspection of parking garages. An initial condition assessment is required prior to a certificate of occupancy or certificate of compliance being issued for a new structure. Existing buildings must complete an initial condition assessment prior to October 1,2019, October 1, 2020, or October 1, 2021, depending on the date of original construction. Following the initial condition assessment of a parking garage, such parking garage shall undergo periodic condition assessments every three years.

Filing Requirements for Applications Requiring Final Inspection by Registered Design Professional
Applications for most work types are required to have the final inspection performed by a Registered Architect or Professional Engineer (Registered Design Professional or ‘RDP’). For more information, see Buildings Bulletin 2018-008.

Cranes Filings (Phase One) to Launch in DOB NOW: Build
As of March 30, 2020, Crane Prototypes (CPs) and Crane Device (CDs) filings (new, amendments, and renewals) must be submitted in DOB NOW. The deadline to submit paper CP and CD applications is March 13, 2020.

2020 NYC Energy Conservation Code In Effect May 12
The 2020 New York City Energy Conservation Code (NYCECC) will go into effect on May 12, 2020, affecting all new buildings and alterations.

Refund Requests for Superseded Limited Alteration Applications (LAA)
Effective immediately, there will be no refunds issued for Superseded (LAA) filings. If the initial licensed contractor (License Master Plumber, Fire Suppression Contractor or Oil Burner Equipment Installer) is replaced on a LAA and a new licensed contractor takes responsibility for the work being performed, the filing fees paid by the initial licensed professional will remain with the application and will not be refunded.

Electrical Plan Review Unit Relocates to 80 Centre Street
On Monday, February 3, the Electrical Plan Review Unit (formerly the Electrical Advisory Board) is moving to the Hub located at 80 Centre Street, 3rd Floor.

Follow-up #1: Local Law 152 of 2016: Periodic Inspection of Gas Piping Systems Required
Effective January 1, 2020, gas piping systems in all buildings, except for buildings classified in occupancy group R-3, must be inspected by a Licensed Master Plumber (LMP), or a qualified individual working under the direct and continuing supervision of a LMP, at least once every four years according to the schedule set out in 1 RCNY §103-10.
